o the policymakers of Indiana, we urge you to take immediate action to address the corruption within Elite Property Management and Realty LLC and Tippecanoe County Animal Control. Elite Property Management manages Spring Gardens Apartments for Consolidated Property Management (both located in Lafayette, Indiana). Indiana codes and policies must be scrutinized and strengthened to prevent further abuses. We call for:

Increased Transparency: Implement mandatory disclosure of financial dealings and management practices to ensure accountability.

Stricter Regulations: Enforce stricter regulations on property management companies and animal control agencies to ensure ethical behavior, as outlined in:

  • Indiana Code Title 32, Article 31: Covers landlord-tenant relations, including the requirement for landlords to maintain habitable living conditions.

  • Indiana Administrative Code (327 IAC 15-2-1): Defines public nuisances and includes excessive noise that disturbs the peace or causes discomfort as a public nuisance.

  • Health and Safety Codes: Covers landlord-tenant relations, including the requirement for landlords to maintain habitable living conditions, which implicitly includes preventing excessive noise and vibrations.

Building Codes and Standards:

  • Section 1207 of the International Building Code (IBC): Requires walls, partitions, and floor/ceiling assemblies to have a sound transmission class (STC) rating of 50 (45 if field tested) to minimize airborne noise transmission.

  • Section 1206 of the International Building Code (IBC): Addresses the structural integrity of buildings to withstand normal forces and impacts without undue vibrations or noise transmission.

These policies must be rigorously enforced to ensure a fair and just living environment for all residents of Indiana. Policymakers must act now to address these issues and prevent further abuses by property management companies and animal control agencies.

Animal Cruelty Code:

  • Indiana Code Title 35, Article 46, Chapter 3: Addresses offenses related to animal cruelty, including the abuse, neglect, or abandonment of animals. It outlines the legal consequences for individuals or entities found guilty of such acts, ensuring the humane treatment of animals.
